1. Definitions
In these Terms and Conditions:
“Company” refers to 360 Pro Group Limited trading as 360 Pro Auto
“Customer” refers to any individual or entity requesting towing, salvage, recovery, or related services
“Vehicle” refers to any car, truck, van, motorcycle, machinery, or equipment handled by the Company
“Services” include towing, salvage, recovery, storage, transport, vehicle removal, and associated activities
2. Acceptance of Terms
By requesting or authorising services from 360 Pro Auto, the Customer agrees to be bound by these Terms & Conditions.
Acceptance may be verbal, written, electronic, or implied by conduct.
3. Scope of Services
The Company provides:
Vehicle towing and recovery
Salvage and accident recovery
Breakdown assistance
Vehicle relocation and removal
Storage (where applicable)
Services are provided based on information supplied by the Customer and site conditions at the time of service.
4. Customer Authority & Ownership
The Customer confirms that:
They are the legal owner of the Vehicle or have full authority from the owner
The Vehicle is not stolen or unlawfully possessed
They authorise the Company to move, tow, salvage, store, or dispose of the Vehicle if required
The Customer indemnifies the Company against any claims arising from lack of authority.
5. Pricing & Payment
Prices may vary depending on distance, vehicle condition, access, recovery difficulty, and time of service
Quotes are estimates only and may change if conditions differ
Payment is due immediately upon completion of service, unless agreed otherwise in writing
The Company may require advance payment in certain situations
Accepted payment methods may include cash, bank transfer, or other approved methods.
6. Storage Fees
Storage charges may apply if the Vehicle is held at the Company’s yard or arranged location
Storage fees begin immediately after towing or recovery
Vehicles not collected or paid for within a reasonable timeframe may be disposed of in accordance with New Zealand law
7. Vehicle Condition & Risk
Vehicles are often damaged, immobilised, or unsafe before recovery
The Company is not responsible for pre-existing damage, mechanical faults, or deterioration
Normal towing risks include minor scratches, dirt, fluid loss, or movement of unsecured items
Customers are responsible for removing all personal belongings prior to towing where possible.
8. Limitation of Liability
To the maximum extent permitted by New Zealand law:
The Company is not liable for indirect, incidental, or consequential loss
Liability is limited to the cost of the service provided
The Company is not responsible for delays caused by traffic, weather, accidents, road conditions, or third parties
Nothing in these Terms limits rights under the Consumer Guarantees Act 1993, where applicable.
9. Consumer Guarantees Act
If the Customer is acquiring services for personal use, the Consumer Guarantees Act 1993 applies.
If services are supplied for business or commercial purposes, the Customer agrees that the Act does not apply, to the extent permitted by law.
10. Dangerous & Hazardous Situations
The Company may refuse or suspend services where:
Conditions are unsafe
The Vehicle presents a risk
Hazardous materials are present
Access is restricted or illegal
Any additional safety requirements or delays may incur extra charges.
11. Salvage & Disposal
Where a Vehicle is deemed uneconomical to repair:
The Company may assist with salvage or disposal
Ownership transfer documentation may be required
Proceeds from salvage may be applied against outstanding fees
Unclaimed vehicles may be disposed of in accordance with NZ legislation.
12. Cancellation & Call-Out Fees
Cancellations after dispatch may incur a call-out fee
Failed access, incorrect information, or customer unavailability may still attract charges
13. Indemnity
The Customer agrees to indemnify and hold harmless the Company from any loss, claim, or damage arising from:
Incorrect information provided
Lack of authority
Unsafe vehicle condition
Third-party claims
14. Privacy
Customer information is handled in accordance with the Privacy Act 2020.
Details are used only for service delivery, invoicing, and legal compliance.
15. Force Majeure
The Company is not liable for failure to perform services due to events beyond its control, including natural disasters, accidents, road closures, or government actions.
16. Governing Law
These Terms & Conditions are governed by the laws of New Zealand.
Any disputes shall be resolved in New Zealand courts.
17. Amendments
The Company reserves the right to update these Terms & Conditions at any time.
The most current version applies at the time of service.
